The Court of Justice of the European Union ruled that transfer of software licenses is allowed

A long disputed matter now has its partial answer, following the decision of the Court of Justice of the European Union (CJEU) of 03.07.2012. The decision was issued following a preliminary ruling request by a German Court that was reviewing a claim by Oracle against UsedSoft GmbH. Huge quantity of counterfeit goods seized at the Bulgarian border

The Customs detained 1 255 counterfeit perfumes and eau de toilette amounted to 125 500 leva in the luggage of a Romanian citizen travelling from Turkey to Romania. The counterfeit fragrances were indicated with the famous brands BOSS, NINA RICCI, ARMANI, LACOSTE. Additionally in the luggage of the citizen there were also 40 pairs of sport shoes and 30 pieces of sport clothing bearing the trademarks ADIDAS and NIKE. Amsterdam Court did not recognise Sofia City Court Decision on parallel import

The Amsterdam District Court has ruled that a Judgment of the Sofia City Court in a trademark infringement case was contrary to the Nederlands’ public policy and it could not be recognized under the Brussels I Regulation.
